Can communicating with bank (defendant) hurt my case.

And when it looks like you may be making some headway they can file a motion to set aside the judgment for a variety of reasons and make you start all over again.

The judgment debtor may file the motion, but unless the reason the defendant didn't show was improper service of the summons and complaint the debtor cannot be assured that the judgment will get set aside. So if the service was good, the defendant takes a very real risk that the default judgment may indeed stick.

I got similar advice to yours from other lawyers. However, they will pay! Here is the demand letter I used to let them know I was ready to pursue this. Hopefully it can help someone else in the future after a judgment. Everything you and the other generous friends in this forum recommended was super helpful! Thank You
