buyer won't pay up

My husband, brother in-law and his wife and I all own a property together. We signed a contract to sell with monthly payments and then a balloon payment (due last July). During the contract period, my husband and I were in bankruptcy however the property was not listed and my lawyer sent documents to the purchaser to state that. We have - since July 2007 only received one payment, what can we do leagally to get him to pay. Can we put a lein on the property? The purchaser is a developer.
 
Maybe I'm missing something here. If you had a contract for sale, and the prospective purchaser hasn't completed, why not just terminate the contract?
