I signed a buyer agency agreement contract in MA
The contract is set to end in Feb 2006. The agent wrote on the contract the wrong year. He meant 2007, but wrote the wrong date for the termination line. The only other date on the contract is from November(11/04/06) when the contract started, which is on the top line next to our names.
The first paragraph states when it is set to end which reads 02/04/06.
Is this considered a clerical error, or is this not legally binding since there is no techincal date or termination set?

Please serious answers, I wrote this on another forum, but so far have single mothers in Ohio giving legal advice. I am not buying a house behind my realtor's back, I just want out of the contract as our personalities do NOT mesh well. Wanted to know if this discrepancy is binding.
thank you!

Q: Is this considered a clerical error?

A: Yes. Talk to the real estate agent about getting out of the contract.

thanks seniorjudge...
but the thing is, when is it supposed to expire then? Are we supposed to assume it should be 2/4/07? There is technically no end to the contract (or beginning really)
yes, this is obviously a clerical error, but I guess my question is, is the contract binding since there is no end (technically) in sight based on what is written?

Ok here are my 2 cents and MY OPINION

A written contract is a written contract PERIOD

That is why you put it in writing.

And that writing has to be clear.

If it is not and does not make any sense then the contract
does not make any sense

Just go to the Broker of this RE agent and simply say this

HEY your RE agent cannot even fill the silly form out properly
and I DO NOT WANT THIS PERSON TO FILL OUT ANY OTHER
DOCUMENTS OUT WRONG EITHER LIKE A PURCHASE DOCUMENT!!!!!

One typo error on a purchase contract and you could have some serious
issues AND GUESS WHO IS LIABLE.

You got it your RE AGENT!!!!

Tell The Broker goodbye and you do not want this typo error
RE agent representing you anymore > and if they will not
listen file a complaint with your state RE Governing Agency.

SKI
