Brother has past, who should have control of the estate?

Hello,
A brother who was 20 years old had passed and his closest blood realitive is his brother who is 19. who should have power of attorney while he was on life support and of is estate? His parents who are devorced or his brother?
 
...well POA doesn't apply since he has passed.

His next of kin would be his parents.
 
Isn't it kind of moot now?

POA would be whomever he selected before his death.

There is no automatic POA granted; if none was granted again his parent/s would be considered the legal next of kin.
