When a husband dies and his will clearly states the wife is sole heir .But one of the sons stills $250.000 in equipment along with precious personal items she takes him to court and it has been 3 yrs of court and 4 yrs. Since death of father . She is suing him to get all items back to be dibursted at her discretion in our small town ever one knows everyone in our court system for example judge is lawyers son ,or lawyers play poker.You have the idea. Her last court appearance at age 73 with Parkinson's her lawyer said he was just going to get a few of the big item ! No wedding rings or inhertied items from her mother and the judge said he did not feel like hearing the case so of course it was rescheduled. Mrs.Peggy is emotionally and physically exhausted. Already paid a lawyer $4000 to tell her they will go for 2 pieces of equipment. Then she was served with counter suit for $50.000 for lack of work when plainly in is affidavit he said the equipment was on a job making him money. This little lady needs real help or real advise. This is going to kill her .Thank you for your time
 
Attorneys and judges often socialize; that's not a big deal, even in small-town Alabama. Mrs. Peggy needs to be speaking with her attorney; that's what she pays him/her/it for. If she is not happy with that attorney, she needs to dismiss said attorney and hire another one.
 
Regarding legal ethics and courtroom protocol: If the judge is the father or son to one of the attorneys, that would be an issue that I'd find very hard to believe would not be raised by a competent attorney. That presents a clear conflict of interest. Regarding attorneys and judges playing poker at their weekly poker game - obviously that never happens. ;) It would be a mistake to conclude there is wrongdoing as a result of socializing. Not only do social / professional / personal activities take place involving attorneys but you may find attorneys on opposite sides in court who may be playing at the same weekly card games. They are advocates who also have lives and many can manage work and personal separately and appropriately.

Without knowing the details, it's impossible for anyone here to give you any adequate reply regarding probate court, attorney competence, etc.
