Broken leg in Soccer game-Nike shin guard broke

While playing in a WV high school soccer game, my son's leg (tibia) was broken from an impact with another player. He is in a cast from his toes to the top of the thigh. The Nike shin guard that he was wearing cracked from the middle to the edge. Should we pursue a claim against Nike? These are some of the best shin guards that Nike offers, ~$50 for the set.
