Medical Malpractice Botched Root Canal

A while back 2-4 years ago, my son was having a root canal. The file broke off during the procedure. The Dentist could not get it out and sent him to an oral surgeon.

The surgeon was unable to get it out.

He says he signed a waiver saying he could not have recourse against errors made.

They gave him the appointment for free.

The file is still in his jaw.

The crown was never finished.

He can not have an MRI because of the file in his jaw.

It will require surgery.

What recourse if any does he have?

He is now having sinus issues that may or may not be caused by this.

He may or may not have records showing what was done. Does the dentist and dental group need to keep these records?

Any help would be appreciated.
 
Go to a lawyer specializing in dental malpractice and tell him what happened.
