Boss did not pay

My son worked 3 summers for a state trooper who runs a lawn service. His boss owes him $1900 for this past summer. After numerous phone calls and actually kind responses from the boss he still has not paid him. He was always paid on the books. Never cash. We or my son is ready to file in small claims. Should he sue the business
And the boss personally?

He paid by check? Were taxes taken out?

Yes. Paid by check. Taxes taken out. My son has 15 weeks of documented hours. He worked 399 hours. Was paid 179 hours plus a recent check of 800.00 which I guess, his ex boss thought that was all he owed him. He owes him 1900 more.
