I just came across this forum today, hopefully someone can help me!!!!!!!!
My boyfriend is being sued by a credit card co for about 9,500 but was never served officially. He just receved a letter in the mail from the prosecutors office stating that he was in default. He knows that he owes them but he is financially strapped right now. He does own 3 homes,including the one he lives in, nothing extravagant just fixer uppers. He is worried that they will make him sell one of the homes for repayment or garnish his wages. He is in financial trouble because the job he took 5 years ago was a big decrease in pay, but would off in the future. He is still and apprenctice and has 1 1/2 more years to go before he will be making enough money to pay off all of his debt. He was told that they can garnish 25% of his net. He also has a son who he takes care of. He doesnt pay child support. Is there anything he can do to defer the garnishment. The debtor will not accept installments. They want one lump sum payment.
