live in california and took out a payday loan from a comany in New Hampshire. California law states that all companies have to be liscensed in California to be able to lend to California residents. The company I took the loan out with is not liscensed in California. I fell behind on some bills and havent been able to pay me back. They are suing me in New Hampshire small claims court. What should I do? Wouldnt they have to sue me in California court to get the money. What would happen if they tried to sue me in California while not having a liscense to lend in California? I read the contract that I e-signed and it said this loan would be governed by the state of New Hampshire regardless of where I live.
