Alcohol & Drugs: MIP, MIC, Intoxication Being Drunk or Stoned as a Passenger

A former police chief of a California city is trying to convince me that you can get locked up for being stoned (on weed) or drunk on alcohol under the following:

"f) Who is found in any public place under the influence of
intoxicating liquor, any drug, controlled substance, toluene, or any
combination of any intoxicating liquor, drug, controlled substance,
or toluene, in a condition that he or she is unable to exercise care
for his or her own safety or the safety of others, or by reason of
his or her being under the influence of intoxicating liquor, any
drug, controlled substance, toluene, or any combination of any
intoxicating liquor, drug, or toluene, interferes with or obstructs
or prevents the free use of any street, sidewalk, or other public
way."

I was pulled over with a friend the other night. The cops accused us of "talking slow." They scrutinized my friend (the driver) pretty heavily then let him go. I was under the influence of marijuana, but I wasn't driving. My police chief friend says that he has had over a 100 convictions with the above penal code. He is claiming that I could have been incarcerated for being high despite the fact that marijuana is legal under California HS section 11362.5. Whats the deal? People get drunk or high and go into a public place all the time.
