As a part of my divorce settlement my lawyer was supposed to freeze my x-husbands 401K and the funds where to be transferred into an account for our childrens education. She forgot so he was able to depleted the funds. Can I sue her for negligence?

Why didn't she freeze the assets -- she simply forgot and then several months later they were, e.g. gambled away one evening? It might qualify as malpractice. What happened to the funds? Has your attorney pursued action in the court due to your ex-husband's contempt of court through his actions? (Was there an order directing your ex to transfer the money?)
