my wife asked a friend to withdraw $100 from debit card at an ATM(she gave person PIN number). the person took an additional $400 without permission at other bank ATMs and gas stations. we have been very patient(4 months). this person keeps saying they will return our money, but has not done so yet. I live in Massachusetts, do I have case against that person even though my wife allowed them to get the initial $100? Will I need any other info like a police report? any information will be helpful.

Delay is the deadliest form of denial.

Yes, theft is still theft although the person who took the money may have a different story than what your wife is saying.

Will I need any other info like a police report?

Yes. Contact by police might spur that person into returning the money sooner.
