I work for Domino's Pizza. I was delivering a pizza to a customer the other day. I was in the middle of a boulevard, started to go straght ahead, when I cauhgt a glimpse of a car approaching me from my right. I hit my breaks and the car proceeded by. The customers house was on the next block. When I stopped and went walked back to the rear door, of my car to remove the pizza, I was delevering the man that was driving the car that was speeding, was standing behind my car. He said"You almost hit me". I told him "I did not see him at first, but I didn't think I came that close to him". He said "He was going to kick my ass". I was wearing sun glasses, at the time, I was taking them off my head at the time, and threw them at him. I was still walking towards him, when he threw a punch and hit me over my left eye, and cut my eyebrow. After that I was trying to defend myself, by trying to push him away fromme. I was kicked in the stomach, punched in the head again, on the same side, then kicked in the abdoman. After this I fell on my back, felt blood running down my face. I sat there for a few secounds, then stood back upand walked back over to the drivers door, of my car. I sat in my car and the guy started to leave in his car. The man who I delivering the pizza to, then came to his door and said" Get his license plate number, he is not going to get away with this". I then got to my cell phone and dialed 911. The police arrived 5 minutes later questioned people who had come out of thier houses as well as the other guy and me. No one sid that they saw who threw the first punch, so we were both taken to jail, for disturbing the peace by fighting. The other person had a torn pocket on his shirt where I tried to hang on to him when I was falling backwards. I had a cut over my left eyebrow, my abdoman was bruised from being kicked twice. The man woks for the city of Morgan City and the police acted as if they knew him. My rights were not read to me until I was arrested, and at the police station two hours later, before my deposition was taken. I had to sit in the drunk tank for 45 minutes, while they processed him. He did not have to sit in the drunk tank, while they processed him! I am wondering what my legal rights are, and how I should handle my approaching hearing October 14th 2008?
