My wife and I put our home up for sale. Our real estate agent came to us with an offer and showed that the potential buyer made well over what would be needed to get a mortgage on our home. So we accepted the offer. Everything was going well although there were some documents that were not presented on the stated dates on the contract. That aside everything was going smoothly until 2 weeks before settlement we found out that the buyer did not make what was stated on the document presented causing the mortgage co to deny the loan. My question is, are we entitled to the down payment?
