I'm wondering if anybody can give me some advice regarding this situation.
I own a home that I am renting to a nice couple and their dogs. When the lease was signed in October 2007-they were interested in buying the house. However, they were not able to afford the house nor get a loan. When the power bill went up this winter (I don't think I have to explain that at all), they told me it was too expensive for them to live there but they would be looking into financing yet at that point. About a month later, I emailed them asking if they were still interested in the house. They said yes. Longer story short...In the end they can't come up with the cash or get a loan. They gave me 30 days notice to vacate. I called telling them they could not get out of their lease until October 2008-per the document, but I would consider a sub-let situation. Again, I didn't hear from them. I called. They said they would honor their lease after all.
Now-here's the thing...I put the house on the market since rates were starting to drop and not knowing whether or not my renters were really truthful in honoring their lease. CYA if you will. They agreed (verbally) they would allow open houses and showings for me. I told them I would definitely take care of them in the end.
They are not letting my realtor enter the house or have an open house. My question is...what do I do "legally" to make sure I'm not breaking the law. I would like to show the house without the tennants in the house. What do I have to do-to protect myself as well as their rights, in order to get this house sold. Is it against the law to have them vacate the house for the Open House? If I give them 24 hours notice that I would be showing the house, must they leave if I ask them? By the way-I live in the state of Wisconsin.'
