Am I entitled to see my mother's will?

My mother recently died and my brother says he is in possession of her will and that she left all of her property to him and nothing to my sister or me. He refuses to send me a copy of the will because he says he wants to protect me from hurtful things my mother put in the will. I understand he must file the will with probate and I can obtain a copy then. It is a small estate and if it does not go into probate and he does not file the will, how can I get a copy?
 
If there is no real property (or titled property) he will not have to go through probate. You can sue to see the will though. You should talk to and attorney to see what they say to do in your state. The consult will likely be free and if it is too small for them to do they may just tell you what to do.
