Alito’s Son Working for Treasury Department - Conflict of Interest?

It's not an automatic legal conflict of interest. A legal conflict occurs when a lawyer represents a client whose interests conflict with another client's interests or when the representation would conflict with other interests of the lawyer, e.g. financial interests. Here, the conflict that might occur is if Alito's son were to be assigned to work on a case that is pending before the Supreme Court. If that were to occur, Justice Alito would need to recuse himself from the case or the Treasury would have to be sure that Alito's son is shielded from having anything to with the case or receiving any information about it. This is known as a legal firewall.

In the federal government there is a general prohibition against a relative of an employee working under the supervision of another employee because that invites favoritism for the employee relative who is being supervised. In this case Alito's son is working in an entirely different branch of government (the Executive Branch) from Justice Alito, who of course on the Supreme Court, which is the top of the federal Judicial Branch. Neither father or son will have anything to do with the work of the other so it doesn't present any problem. It is not uncommon for spouses or relatives of one federal employee to also be employees of the federal government too. So long as the rules that the Executive Branch has for this there is no issue.
