Accident Involving broken traffic light

Last week, I was involved in an accident in NYC, a block away from my house. The traffic light at the intersection has been broken for weeks now. Its a steady red & green light. As I approached the intersection, I came to a complete stop. The car at the 90 degree angle waved me on. As I edged out into the intersection, a 17-year old kid thats not from the area slammed right into the front of my car. He just got his license a week ago, was not aware the light was broken, & assumed since it was a steady red & green, that he did not have to stop. The cops were called & my car is in the shop now, waiting for the insurance adjustor. I suffered a minor back injury. Is New York City liable at all since the traffic light is broken? Of course, the very next day, the light is now blinking red, but people still go right through it. My insurance company said the City should at least be responsible for providing me with a rental car, but I don't know how to go about doing that.
Can you please advise me what to do?
