Hi, this is about a website that provides a service to its members that allows them to upload and backup their files and songs.

The files cannot be searched by other members, however the songs can. If said songs are downloadable (selected by the user) then anyone can download them once finding them, and if they're public, whether downloadable or not then people can play them.

The site itself does not provide songs for you to download, and has stated specifically that you're not allowed to download songs if you do not have an original and are downloading the songs for backup purposes only. This is mentioned on every page you can download songs and is also written in their licence agreement, which is very long, to try to cover this sort of thing. It states that the site is not liable for what is put on it, nor for people downloading, and you have to accept these conditions to sign up to the site. No porn is allowed to be uploaded on the site, and if a user is found to be abusing any of these rules by any means then they are removed from the site and banned.

Is this a good enough cover for the site's liability? And if not, how would they be able to improve on it to be able to cover themselves. I know the owner and promised I would research it for them.

A: Anyone can sue any body else for anything at any time any where.
 
This is true, but how would they be able to avoid being sued as much as possible? Does what they've stated at least cover them against the biggest liabilities?
