THE BEST LAWYER STORY OF THE YEAR

A Charlotte, NC lawyer purchased a box of very rare and expensive cigars
and then insured them against fire among other things. Within a month,
having smoked his entire stockpile of these great cigars and without

yet not having made even his first premium payment on the policy, the lawyer
filed claim against the insurance company.

In his claim, the lawyer stated the cigars were lost "in a series of
small fires." The insurance company refused to pay, citing the obvious
reason that the man had consumed the cigars in the normal fashion. The
lawyer sued.. and WON! (Stay with me.)

In delivering the ruling the judge agreed with the insurance company
that the claim was frivolous. The judge stated nevertheless, that the
lawyer "held a policy from the company in which it had warranted that
the cigars were insurable and also guaranteed that it would insure them
against fire, without defining what is considered to be unacceptable
fire" and was obligated to pay the claim.

Rather than endure lengthy and costly appeal process, the insurance
company accepted the ruling and paid $15,000 to the lawyer for his loss of the rare cigars lost in the "fires."

NOW FOR THE BEST PART...

After the lawyer cashed the check, the insurance company had him
arrested on 24 counts of ARSON!!! Using his own insurance claim and
with the testimony from the previous case being used against him, the
lawyer was convicted of intentionally burning his insured property and
was sentenced to 24 months in jail and a $24,000 fine.

This is a true story and was the First place winner in the recent
Criminal Lawyers Award Contest. :)

Hilarious and I've heard this one before. I'll be posting another great legal story with case cites of a person who received a $5 million dollar jury award (key is "jury") because he discovered, much to his horror, that his brand new BMW was actually used! The horror...

I created a special section just for legal jokes because many of us enjoy the humor, especially us self-depracating attorneys. :D Feel free to post more about any cite you may have for this case. This is, by no means, a reflection on attorneys but more upon the unfortunate greed that exists in mankind.

Apologies for the late reply...

That is one of the most amusing claim-related stories I have heard!!

"Poetic justice" served in that one, I feel!! :D :D

Cheers for sharing,

JJ. :)

Oh, and to add to the above...

If you have any more, please do share them ~ I may not be a "self-depracating attorney," but I sure do like a good chuckle!! :D :D

Regards,

JJ. :)

I think the $5 million verdict was this case. It was just incredible.

BMW OF NORTH AMERICA, INC., PETITIONER v. IRA GORE, Jr.

It's a disgrace although it is somewhat "funny." I'll try to post it.

Nothing to do with the ubove mentioned!!!

But i must say i love this new outlook on this site, It is very pleasing to navigate and seems to be up to date in comparison to sites i have visited!

10 out of 10 to the webmaster! I love this site it has been very imformative and the advice i have recieved has been to the point. I like to think i have helped a few people out along the way also.

So keep up the good work and long live the LAW Forum.

All the best from the UK.

Mark.

It is really a threatening story. So painful. The sharing of this story will be teach a lesson to all.

Unfortunately the BMW case is 100% true. I read it in a law bulletin and almost fell over when I read it. I wasn't surprised when I saw that the decision was based out of some very wealthy area in Connecticut where having the "disgrace" of being sold a "used BMW" could be worth the pain and suffering of $5 million dollars. The horror, the horror...
