I am 19 was caught shoplifting at a local grocer.. The merchandise totaled about 45 dollars. A police officer was called and I was handcuffed but not taken to the station (released on site). I have a fine for 366, it was my first offense and I am very sorry for it and totally believe I deserve the fine. However, my boyfriend gave me a switchblade from chicago for protection (I often have to walk a while to my car very late at night for work) which is illegal in wisconsin and was, of course, found and confiscated by the police officer. I told him everything and was very compliant. My questions are this...

1. How much will court fees cost, on average?
2. Will my boyfriend get in trouble?
3. What will the likely consequences be for the switchblade possession?
4. Do I qualify/should I apply for a public defender?
5. Jail time?

1. How much will court fees cost, on average?
That depends were you charged for the knife as well or not?
2. Will my boyfriend get in trouble?
Why? Was he there?
3. What will the likely consequences be for the switchblade possession?
Were you charged for having the knife?
4. Do I qualify/should I apply for a public defender?
Since we do not know your income thats hard to say
5. Jail time?
Without knowing the charges or your record (if any) we cant say. However if your record is clean then no jail I suspect

I was not charged with the knife, however although the shoplifting charge isn't mandatory, the court date for the knife is.

2. Will my boyfriend get in trouble?
Why? Was he there?
No, but I told the officer he was the one who gave it to me

Low income, I work in a mall

First time offense, never even had a traffic violation or a ticket for littering.

( So you have or will be charged for knife)

No, but I told the officer he was the one who gave it to me
(I doubt they pursue him)

(Then I suspect yes)

That really sucks.. I know this is retail, but have you any idea of the fee?

p.s. thank you for your prompt responses. this site has definitely made me feel like I'm not alone.

We deal with retail theft issues here and know little about other laws. a quick call to an Attoreny should get you fee for knife but I suspect its less than $400.00.
