1 more ?/ annuity up for grabs?

Forgot to ask about this as well. My father received a check from my grams annuity, he was the sole beneficiary. The financial advisor assured us that it is separate from her estate and will..it is NOT mentioned in the will, no burial trust, etc... So, the executor (uncle) says he wants this annuity as well to add into her estate and split between her sons. Told my dad he's gonna fight for it. Does he have a right to it?

An annuity (like life ins.) passes outside the estate & goes to the beneficiary named.
