1-Group LTD Policy 2- individual LTD policies - HIPAA - SAME INSURER WHO TRUMPS

I went on STD 10/05 -group policy. Short Term Disability went to Long Term Disability (group also different insurer) 01/06. My initial diagnosis changed from GAD and MDD to Neurological (seizure disorder, possible MS) in 04/06. All Attending Physician Statements indicated the new diagnosis.

At the end of my 2 yr Mental LTD cap the insurer still had not changed the diagnosis. At that point I was waiting for cervical spine surgery to remove and replace C5-6 C6-7 and place a titanium anterior plate. Two days before surgery I fell, broke my nose and eventually had surgery in 02/08.

In January, 2008 the LTD Insurance company sent me a letter outlining my medical issues in detail, discussed my applying for social security and my 2007 Federal Income Tax Return. they sent a cc of this to my former employer, who fired me 7/1/06 while out on disability. I have been told that the insurance company letter sent me apologizing for the mistake is all my recourse because of ERISA.

Why did I lose HIPAA under my private policies?
