Vance/Stone vs Mariah Carey, et al

How I figure is he filed the lawsuit last week and that is five years after the limitations period ended on copyright. You have three years from the time of discovery (and its going to be hard again to argue that a song as popular as they admit Carey's is) was not discoverable as soon as it...

    Arbitrator Selection in Minnesota

While not mandating AAA, does hold it up as an example of using it as that contractual remedy. I just want to tell you both good luck. We're all counting on you.

Vance/Stone vs Mariah Carey, et al

I'm not seeing the similarity other than the concept of "I don't need any Christmas presents as long as I get you." Alas, such is hardly a unique theme in love ballads either. Swirsky was a pretty profound loss for him. He lost via summary judgment and it was the appeal of that which came...

    Arbitrator Selection in Minnesota

Generally the industry has a pool of arbitrators. They all submit discloures that would flag any bias for or against any of the parties. I am a FINRA arbitrator.

Vance/Stone vs Mariah Carey, et al

This is about the dumbest lawsuit I've heard of. First, titles are not protectable by copyright (they already admit the songs have different lyrics and music). Second, he's about three years too late to file...

    Applying for Naturalization/Citizenship

And I believe I answered both that and the question he did ask. Actually, he can lead his application for naturalization by 90 days as well. Gets a jump on the processing.

    Applying for Naturalization/Citizenship

As Zig says, you have to be a US citizen / national to get a US passport. A US national is a non-citizen that has an special allegiance to the US (mostly due to residing in an outlying US possession). As an LPR, you can enter the US without a passport, but you're not eligible for a US...

    Speeding ticket Suffolk Co Ny

Not only points on the license, but there's a CASH surcharge that hits after you get those points. 25+ over the limit even without reckless driving or any other NY State infractions is enough to trigger that surcharge.

    Speeding ticket Suffolk Co Ny

I presume that since you mentioned your PO in this that you reported the arrest already as required. They have pretty broad discretion on interpretting the terms of your probation which we don't have a clue about. However 25+ speeding in NY is nothing to sneeze about. There's some onerous...

    No health care proxy

Here's an AMA Journal article on the subject: Who Makes Decisions for Incapacitated Patients Who Have No Surrogate or Advance Directive? TL;DR summary: Mostly it is a physician's call unless something forces the issue to a guardianship. I disagree with zd on this. Healthcare providers...

Baby Mama holds car hostage with TPO

I assume you mean "no contact," Why are you not talking to your attorney about this? Typically, the way you recover something from someone you have a restraining order from is have a neutral party (the lawyers will arrange this) do the recovery.

    What are the odds

You can't try dead people criminally. A crime is not victim vs. defendant. It's society that is harmed by criminal behavior and the state brings the case on the public's behalf. On the other hand, the estate can be sued civilly, and if there is insurance involved that can help. What...

How to get control over aging mother's affairs

If she is lucid enough to sign legal documents, and you can convince her to sign power of attorney (might as well get them crafted for regular and medical issues as well as an advance medical directive). If not, AJ is right, it will take showing in court she's not competent.

Rebuttal to Denial Letter from Opposing (State Farm) Insurance Company

You can rebut all you want, but they're going to ignore you. Time to file the lawsuit (unless you have an insurer to duke it out for you).

Fake Wikipedia Page -- Domains by Proxy

I have no idea what you are talking about. Your link is malformed. If it's really wikipedia, you can just edit the bogus content away. If it comes back, there's a process for that: Wikipedia:Dispute resolution - Wikipedia

Mobile carrier X fails to send me gift card

I have found that dealing with cell carriers that perhaps the best way to get attention is to go to the FCC.GOV site and click on the "file a complaint" link. This will eventually get routed to the carrier's legal group who are empowered to offer you stuff to resolve your complaint.

Background Check - Misdemeanor from 30 Years Ago

I worked in the intelligence industry and most of my employees had clearances that I can't even divulge the names of in public. I had one guy who was caught driving home from the office doing over 100 MPH on the freeway. He ended up spending four days in jail for that criminal speeding...

In the state of Pennsylvania, is it illegal for an employer to blacklist a former employee?

WIthin our company, we'll often mark do not rehire on things when someone quits (and certainly if they are terminated for cause). I had a guy literally quit the morning I was going in to fire him. Several months later I get a phone call from HR at another company: HR: Mr. Lee used you...
