    Tired of all the chaos

I'm not all that positive the OP has a case that an employment lawyer will actually take.

    Tip Income on Unemployment Application

Same answer I just gave you on the other forum where you posted this question.

Terminated due to medical illness or illness's

"Reasonable" is subjective. The employer doesn't have to comply with the accommodations the physician suggests. Was there a discussion about what would have been reasonable in their opinion?

    Fraud-payroll clerk cashed my check

The company is not required to keep cancelled checks that far back. I can't believe you didn't know you didn't get paid at the time. When you got your 1099-MISC did you even check it against your record of payments? If you had, you wouldn't be in this fix now.

    Getting paid after I quit?

Well, actually, there is no reason for an I-9 at this point. The poster has already quit. All the employer needs to pay you is your name, address and SSN. Even a W-4 is not required, as they could withhold at Single-0 without one. Quinb, when was your last day worked? When should you...

    Fraud-payroll clerk cashed my check

In 5-7 years you have not had the time? Wasn't very important to you, was it? I would tell you to go jump, personally.

Who owns the personal documents save in the employer's laptop after I am dismissed?

Didn't I say that nearly a month ago? Yes, I did. Alice, you might as well consider those documents lost and start recreating them.

    Getting paid after I quit?

Of course you have to be paid. Have you contacted the employer? What do they say?

    Fraud-payroll clerk cashed my check

The laws are totally different for employees than for independent contractors. That would have been a good fact for us to have known at the beginning.

    Fraud-payroll clerk cashed my check

You think maybe you should have said something earlier? Sheesh. The state DOL will not even take your claim for unpaid wages this many years later. And employers aren't required to keep payroll records that long, either. In fact, the great majority 2004 records could have been destroyed this...

    Deferment reason to fire?

Wait a minute. "Volunteering"? If you were being paid for 20 hours per week, why would you not be paid for the rest of the time you worked? What type of work do/did you do there?

    Federal Mandatory Overtime

And actually, the "one day's rest in seven" has been intepreted by the DLSE in that as long as you get the equivalent of one day's rest in seven over a month, that meets the requirement. And this is assuming that California law even applies on a federal military installation.

    employer bullying

The only thing I saw in your post that was possibly illegal were the perceived threats of physical violence for which you could theoretically file a police report. However, if all they were, were threats with no action, don't count on the police to do much. Cussing, threatening, belittling...

    Out-of-state subpoena. Time off?

If this case is not related to your employment, yes, the employer can make you use vacation/PTO time to get paid for those days.

    employer has no w-2's

jharris has a good point. I just assumed that she was paying you under the table. Which, of course, if you were told you would make $4.00 plus tips, and you received $4.00 per hour in cash every week or every two weeks, that would have been a logical assumption to make. OP, what were you...

    employer has no w-2's

Then you don't know yet whether or not the company will issue you a 1099-MISC. In the meantime, you should put together your hours the best you can, on a week by week basis. Then, by week, multiply that by the minimum wage and compare it to the pay you got for the week, including any tips...
