    fired

Of course you don't have a law suit. And you were not fired. Your resignation was accepted immediately. Call your new employer and ask if you can start earlier. Or file for unemployment. Although there is a one week waiting period in your state, you may qualify for benefits for the...

Not paid for work and bad/no references

Why the registered agent? Why not just the owner of the company?

Company altering productivity bonuses / Working off the clock

So, who is this person that he has system security access to make these changes? Rounding is allowed to the nearest quarter-hour, as long as it is done consistently; for example, the converse of your example, it you clocked back in from lunch at 12:37, the time would have to be rounded to...

Employer threw me off workplace property

Could be. Was this your boss that did this? Does the company have an HR Dept/person?

    Can a non-compete be upheld if I was laid-off?

Honestly, have a local attorney review the document. Noncompetes CAN be enforceable, but such enforceability (or not) is state-specific and there is no way we can tell without reading it in its entirety.

    Backdating a termination date?

Just to clarify, I'm not saying you have a case for a civil suit necessarily, what I'm saying is that you have an argument.

    Backdating a termination date?

They can use any date they like, but I think you have at least the discussions of a case. However, do NOT hold their equipment or files. You may have a civil case, but if you don't return their property, that could be considered criminal (theft). Two different issues.

Unpaid wages and Hostile work environment

You can try filing a complaint with the state Dept. of Labor for refund of the $25 deduction. It either works or it doesn't. Any form you complete for the employer becomes the employer's property.

Unpaid wages and Hostile work environment

For any NSF fees not reimbursed, you can bring a small claims action; the state DOL addresses wages only. Cussing you out is not, in and of itself, illegal. Calling you vulgar names might be, but you've already quit, so what would you expect of a lawsuit? You can't sue for embarrassed or...

Giving Former Employer SSN AFTER I stopped working for him.

How is he going to do a 1099-MISC if you don't give him your SSN? Without a W-9, he should have been withholding 28% of your gross for federal income tax. His accountant is probably yelling at him right now.

Not paid for work and bad/no references

All I'm saying is that it is rare to have vacation policies where you are entitled to take vacation before you have earned it without repercussions. Even though the owner approved the time. Is there no other policy that would add to our understanding of the vacation situation, such as an...

    Exempt Violation

If you are performing nonexempt tasks more than half of the time, the exemption is lost. It would be hard for the employer to state that you are still "managing the restaurant" as your primary duty when you are spending more than half your time being a cashier...

Not paid for work and bad/no references

IF you win in small claims court. The state DOL does not have the mandate to order that NSF fees be reimbursed; only that the wages be paid. It is not unusual, nor illegal, for vacation to be earned on an "as-you-go" basis, and not be able to use paid vacation until you have been there fore...

    Unethical Promotion in Corporation

Not legally, no. There is no law for private employers requiring posting of open positions. None. Zero. You may well have been. But unless it was because of a protected characteristic (under Title VII) of yours, such as your race, gender, religion, national origion, etc., it is not illegal...

    Unethical Promotion in Corporation

You have no grounds for legal action. From what you posted, this was a management decision not related to any protected characteristic of yours. Honestly, though if you are now clinically depressed because of this decision (which you had NO control over), you need to seek help. Or let it roll...

    Promotion Haults (please help)

You could file a complaint with the EEOC or the state equivalent. However, it the burden of proof would be on you to show that the ONLY reason you were denied the promotion was because of your gender.
