Paying out vacation time upon leaving a job - NY

If you haven't seen the policy, how do you know? Just because you are allowed to TAKE the vacation as of January 1 doesn't automatically mean it is deemed earned and vested as of January 1. However, if you are correct, NY law is rather unique in that vacation remaining must be paid out unless...

Problems getting paid on time, possibly at all

OP, you posted this question on another forum, right? I just responded there. I just noticed, however, your comment regarding your first two weeks "holdback". Are you sure you have never received those wages? Or is the employer just paying "in arrears" (i.e., after the fact--they do...

Business owner filing for unemployment compensation

You can certainly file. The problem I see is that the state will deem your forgoing paychecks as indicative not of an employee first, but as an owner first. One of the drawbacks of being in business for yourself.

    Contract Issues

Why in the world would you have to live somewhere relative to your employment when you've been fired? Something isn't making any sense. You didn't get a copy of the contract when you signed it? Have you asked for a copy now?

    Insubordination Questions

IMHO, it's petty and childish. But here, there are no laws against managers being so. In a few states here, the law provides that employees may rebut a negative review in writing and have such writing placed in their personnnel file, though. And "insubordination" is in the eye of the...

Fired from job & given lame excuse

The truth was she got fired for contacting the family when it was obviously not her responsibility to do so. If she was that concerned, she should have reported the situation to the Director of Nursing or the Administrator and let them handle it. This is not the job of an administrative...

Company is not paying for work done 4 months ago! I need help

I'm not saying companies don't do it. I'm saying that these companies have been targeted in the past few years for misclassifying workers as ICs. Just because it's common in the industry, doesn't mean it's legal.

Company is not paying for work done 4 months ago! I need help

If you're desperate, you can always try a small claims action. Jurisdiction might be an issue, though. As sad as it is, you pays your money, you takes your choice (as my g-pa used to say). A small claims action will come up in court more quickly than the DOL could probably get to your wage...
