Is This Legal?

In accordance to my partner whom I am to be getting an apartment with, I had found this no fee broker to help us get this apartment. The unfortunate part about all of this, was that the landlord of the building would not accept us as tenants due to a bankruptcy he had from 4 years ago, and my limited credit history. Therefore in order to do it, they would of accepted 5 months up front and security.

Which I did. A cashiers check in the name of the address and to the landlord of the building. Also a seperate check written out to the same for the security.

I believe I did this at the beginning November, and the lease begins Dec 1st. I signed all the paper work, it was all legit. Was at the brokers office, etc. So says my partner, it is okay that they state that the lease will be mailed to the new address. So I was okay with that. He said its typical for them to mail the lease. Okay, fine, I have my cashier's check receipts and whatnot...

Now we're about a week from our move in date. We decided that instead of Dec 1st, we would move in Dec 2nd. Which is obviously okay. We already subleased our current apartment and have movers coming in the morning of Dec 2nd. The new tenant will be moving her stuff during the late afternoon. We've been contacting the broker on and off for the past 3 weeks to get the status of the new apartment. Its being built from the ground up. I of course read the entire lease. Stated that there would be all new appliances, new everything. Gradually we got the status of the apartment. The dry wall being put up. The appliances being installed. The new video intercom system, etc.

Heres the irritating part, which I'm curious as to whether or not it is legal:

I call the broker again today, since he's the middle man in all of this. I called to ask him when I could pick up the keys for the new apartment. He gives me this spiel about how hes unsure because the landlord needs to get inspection approval for the new apartment and hasn't even done that yet, and may take perhaps a week after Dec 1st. Excuse me? No, no, no. Basically if this doesn't get done, we're homeless.

Whats there to do aside from force him verbally to do something?? We have a week left.
 
Not much since you cannot move into a property that is not been inspected and considered safe to move into...
