This is my situation, I am an American citizen married to an American citizen, but the man that fathered one of my children is a Belgian citizen which I am still in close contact with. On the American birth certificate of this specific child it lists me and my American husband as the parents. Both the biological father and I were wondering about the possibilities of obtaining Belgian citizenship for the child so he can have dual citizenship. Is this possible? Also, would a paternity test be necessary?

I contacted the Belgian embassy and this was the response that I recieved back from them, "The Ministry in Brussels has responded to your question in regards to the nationality of your son. Their answer is that, since your son and his legal father are both American, the paternity must be determined according to American law. It is only after the paternity issue has been solved, that they will be able to examine the possibility of obtaining the Belgian nationality for your son."

To satisfy their requirements they want paternity determined according to American law before they allow us to proceed with seeking Belgium citizenship. What do we need to do to prove paternity under American law?

This is not legal Advice!

Basicly, they would like you to present them with a paternity test which is done under legal terms. for example: you have the test and have it verified by a US Court of Law also your child and the natural birth father and then they will make a determination of the POSSIBILTY of obtaining the Belgian nationality for your son. Sounds very costly!

Why did you list your american husband as the father? Your husband is the legal father and it is state specific on whether or not your husband can dispute paternity now. Generally there is a short time frame to do this.
