I got a certified letter from the owner of my old house. We sold it at the end of November. They had a home inspection done, their mortgage company inspected as well and they had a final walk through. The letter states that a "couple of weeks" after they moved in the downstairs ceiling began to show leaking stains from the upstairs bathroom. We had provided a warranty with the sale as our real estate agent advised us to. The new owner states that the warranty company wont fix the problem because they told her that due to the "rotting wood and mold growth" the problem had been going on for greater than six months. They also told her that there was "cover up paint" on the ceiling. She is asking us to contact her to "resolve" the issue as she "doesn't want to go to court for liquidation damages". We never had any plumbing problems when we lived there. The house was only two years old when we moved in so we never had a reason to paint the ceilings, the house was immaculate. It seems like the home warranty company is trying to screw her. We had no knowledge of any problems. Should I call her? My family is divided on what to do. It seems that if I contact her I will be opening up a can of worms. My sister said if I don't respond it will look like I'm hiding something. What should we do?

Talk to your Realtor and ask his/her RE firm to hire an attorney to respond FOR BOTH OF YOU...depending on the size of your Realtor's office, they may well have insurance to cover this....put your Realtor in the picture as this will expand to the home inspector and others...not just you
