I am trying to find out if there is a law that states it is a crime for a recently turned 17 year old boy to date a soon to be 13 year old girl in Palm Beach County, Florida. Local police officers say it is not a crime but, are not 100% sure. Can you help answer this one?

In most States, ages 13 and 17 are still "minors" and as such there would not be any Criminal Violation. However, once the male turns 18 and the female is 14, will result in a Statutory Rape violation, should a sexual relationship occur. In California, Statutory Rape is a "Wobbler", meaning it can be Charged as either a Misdeameanor or a Felony. Typically, it depends on the age variation of both parties. Best to contact your D.A's office and ask for assistance.

Date is a vague word in this context. What was stated is true -- you can be prosecuted for rape if your relationship includes sex, regardless of whether consensual. If you think about it, you could be applying for college while the girl is still in grade school -- seventh grade. That is a large age difference, especially intellectually. I think you can understand that kids in grade school are, perhaps, not as mature or as experienced with life as those completing high school. It doesn't matter how mature they "seem" to be -- they simply haven't lived enough years for society to feel comfortable that they are able to make appropriate decisions, especially with something as serious as a sexual relationship and its consequences.

You should think very hard about whether you want to have such a relationship and the issues that may arise should you choose to pursue it.

So do you mean that if there is no sex between a minor and an adult but they still are "together" it's not illegal?

from what I read I gather that she is 12, the boy is 17? The cops got involved? That means someone complained, probably her parents.

He is in dangerous waters here, as the others here have pointed out the sex laws. Be aware that sexual contact does not need to be sexual intercourse, the parents can easily get him into trouble for a kiss alone.

Even when there is no sexual contact whatsoever, in some jurisdictions he could be sued for infringement of parental rights, if the parents prohibit their daughter any contact with him and he is seen as enticing her, or otherwise making her contact him.

Therefore he really should think twice.

This is probably right on the money. There is a rather sizeable age/maturity gap between a boy who is a junior in high school is 'hanging out' with a student in the seventh grade. My guess is that someone complained and pushing this is just asking for trouble and there is really no need for this.

Everything you need to know to answer this has been said in this thread and also in the other one where the situation is exactly the same as you describe.

Morally: you must know. I think it is not right,

Legally: read the postings above.

New twist on dating

Recently in a discussion group, the following came up. As leader of the group, I said I felt it is both morally wrong and illegal. My answer was challanged since both people involved are over the age of consent (New Jersey is the location). Based on other posts in the threads, I stick with my answer.

The situation is: A minor male age 16, wants to "hook up" with another male age 25. Hook up is being defined as masturbation, oral and possibly anal sex between two males.

Aside from the moral issues, I see this as pure trouble for the older male even though the younger male is the agressor and made initial contact in a chat room.

Previous replys in the threads relate to heterosexual relations. I guess the same apply to homosexual relations. Was I correct in stating that even though the minor is above the age of consent, the "hook up" would be illegal, or if not illegal, open the older male to possible lawsuits due to parental rights? Also, could it be argued that the 16 year old is not mature enough to make the decision about his sexuality? The 16 year old stated in the chat room that he has had previous homosexual experiences with men both his age and into the 40's. The 16 y/o has also stated his parents know he is homosexual and know he has met older men, but not how old.

Help me convince the group this is not good.

But what if the parents consent? If the parents of the minor are aware and approving of the relationship (still non-sexual) then is it still a major legal issue?

The parents cannot make legal what is illegal. If the parents approve of and permit a sexual relationship that is prohibited by law, the parents will find themselves in jail along with the perpetrator.

17 yr old has no business doing aNYTHING with a 12 yr old. Kissing is sexual and is likely a crime. There is obvious some intent.

I don't know who you are in this, but if you are a parent of one of these 2, i would be putting a stop to this immed.
