Okay, this may take a moment but, I'm literally at my wits end on this situation.
My younger brother is a father of two and his girlfriend was found under the influence of meth, he was proven to be clean. They took his kids, CPS forced him to do all of these crazy specific things, and now they're claiming that he has previous charges about a step-child he has somewhere else...he has never been married, or even dated anyone before with any kinds so we know this is a lie. On top of this there is, his current girlfriend's daughter (not his) is in an institution for the mentally unstable and has suddenly come around talking about sexual assault by my brother.
We've failed every attempt to get legal advise here, and on top of that every lawyer we've talked to in the state want's upwards of $30k+ to even look at the case. We are not wealthy, and it feels like the government and the state together simply want nothing more than anyone at or below poverty level to suffer. There is clearly no such thing as justice in the United States and there is little more than I find I can do at this point. Drastic and possibly irrational measures are the only and last things I can think of at this point...

No one is required to talk to CPS, one need not allow CPS to enter their home.

To talk to CPS or allow CPS to enter your home is submitting yourself to their unprofessional, unpredictable will.

Child abusers and child molesters intinctually KNOW that CPS must obtain a warrant to really harm them.

The unitiated start yapping like Niagara Falls and end up in your brother's predicament.

Smart men and women KNOW not to become involved with drug addicts.

Your brother doesn't have to hire a lawyer.

The taxpayers of Texas through the judge will see to it that a competent member of the defense bar represent his interests zealously.

Be of good cheer, justice is still dispensed daily in the Republic of Texas.

Your brother needs a lawyer. That's about the bottomline. The lawyer I ended up using for my divorce was working from home at the time so my divorce was cheaper than most others (and my ex never showed up). Maybe try to find any lawyers who have their own practice from home? Or just keep trying attorneys to find one that may take on the case at a lower retainer to start with or work out a payment plan.

The federal government nor the state is out to get your brother specifically. Why would they be? Sometimes there is justice...and sometimes not. The wealthy do have a leg up on the poor in the ability to hire better representation but that's just life.

No. They might have influenced his decision making, but they aren't able to do much at all without consent or a court order. Your brother likely consented, possibly without realizing he has the option to say no.

You did not specify that he has actually been charged with a crime. This sounds like it is simply a custody issue.

No he has in no way, shape, or form given consent to anything. He may not be the smartest individual in history, but, this is something he is well versed in, and I have been here this whole time.

I apologize for being forward here but, this is literally a very delusional response. There are well over 3000 plus cases of CPS stepping over their bounds on a yearly basis, and it's just as bad here in texas as it is in any other state. Possibly more so with the given that authority figures in the area seem to believe they have the right to say what goes and where you're allowed to stand in defense of your position. I've been studying this situation since the moment it started, and everyone is doing EVERYTHING in their power to see to it that my brother is unjustly accused for something he did NOT do.

Unfortunately no, they've done this exact same thing to my dad and are currently holding him under thumb threatening him with 5 to 99 years should he step forward about the issue. My brother is currently trying to stop them from charging or arresting him. Which is seeming more and more likely as the days proceed.

Then there must be a court order involved.

Since the parents are not married it may be possible his consent was not required... Maybe there is a paternity issue involved before any parental rights are recognized.

What is the goal here?
