My parent passed away while living with a person, can I get my parents stuff legally ? Asked for and was refused.

If your parent had no will and died intestate and had no spouse and no other children then you inherit all of your parent's property.

However, to get it you will have to open probate, get appointed representative of the estate, and prove (with documentary evidence) that your parent owned whatever it is that you want.

You would have to do the same thing if your parent had a will naming you heir and nominating you as executor.

What if the father died and mother is still alive? Its the father who makes the will? Am I right with that?. Can the mother also has the right to make the will? kindly let me know regarding the same.

Any adult human being can create a will irrespective of gender.

An adult male creates ONLY his will.
An adult female creates ONLY her will.
Once a spouse dies intestate, the other spouse can decide what to do with the stuff that formerly belonged to the deceased.

If you want your son Rakish to have your 24 karat gold "Make America Great" baseball cap worth $25,000, but fail to so state in a will, your spouse can simply give it to her lover, Quinton; who she's been cheating on you with for the last 14 years.

In fact, many wills mysteriously get destroyed, misplaced, or ignored once you've assumed room temperature.

If that $500,000 you've saved must go to Mahindra, there are better ways to ensure Mahindra gets the $500K than through a will.

A will must be probated.
The probate process allows the government to steal 50% of what you left to transfer it upon your demise.

Take me, for example.
I gave away all the stuff my children and grandchildren wanted (or I wanted to give them) 10 years ago.

There are many legal ways to do that without waiting for someone to steal it, or allowing the government (in true crime boss fashion) to take half in some silly court proceeding.

Do whatever you can to avoid ever appearing in any courtroom.
Why?
Because you'll be mugged and its all legal.
