contract dispute with N2 Publishing

A contract with N2 Publishing clearly states the one year term of 5/2014 to 5/2015. It is for an 1/4 page ad in a Neighborhood Monthly magazine with 12 publications.

The ads were delayed for 3 months and began in Aug 2014. They expect and have stated I must pay for the entire 12 months which takes the ad through Aug. 2015.

A written statement has been sent that I wish to cancel my ad, pursuant to the contract in May 2015.
 
I don't see where you ask a specific question. However, the wording in the contract should apply. You can run the contract by a contract attorney if you wish. They are it seems still giving you 12 months of ads though.
 
I am cancelling my contract with N2 publishing in Katy TX. The saleswoman said that I would get a lot of business from my ad in the neighborhood magazine. After 5 months not even one single enquiry. The contract is for one year.

I emailed the saleswoman and N2pub telling them that I am cancelling my contract half way into it. She offered my a buy out if I paid for three additional months but I refused. I told her I am willing to pay a $300 cancellation fee but that's about it. Then I got an email from N2 that the contract is not cancellable by the merchant and that they will continue publishing my ad. I told him that would be at their own expense and risk as this is my notice of cancellation until a small claims court makes a decision.

Now my question is, do I need to file a complaint with small claims or wait and see what they will do. And what do I expect that they will do?

I am interested in the price you paid for the ad size. I was targeted for other ads I placed with affluent magazines and I feel they gave me a higher price than other costumers. I need proof this happened so I can sue them for fraud. Did you personally receive any copies of the magazine? I only received one copy in 9 months. I wanted to cancel the ad as well and told me I couldn't. They now have a lawyer from Arizona calling me multiple times a day and have called all my family members, even in other states, and telling them I owe money and how much owe. I would like to join you to file a complaint with small claims. Two may be better than one.
