Breach of contract

In April of 2015 I went to a cat lot seeking to purchase a car from them. I found the car I wanted, which is a 2005 Cadillac STS. I took the car on a test drive and upon my return to the car lot I informed the sales manager that I'd purchase the car and make the bi-weekly payments if a few things that was wrong with the car was repaired. The deal was made and I paid the required down payment toward ownership. Once that was done I was given a day in which to bring the car back along with what I wanted repaired besides what was already known to the dealer. I did as instructed and dropped the car off at the agreed upon time. After two days has passed i was informed that the car was ready to be picked up. I retrieved the car and right away noticed that I was having the exact same problems with the car. I called the dealership and informed them of the situation and they had me bring it in again. This time when I got it back i was informed that the tires had all been changed and the wheel hubs also was new. I again retrieved car. Same problems.
At no time did I receive any copies of the work orders to show that any and all of the agreed upon with was done. I began to ask for my copies of all work done on my car by this dealership. No records. In fact the one work order that I did finally get from them was no more than lies. I still have the same problems with this car and they are now telling me that they weren't there when I purchased the car and that the former mechanic took all the other records on my car. It appears that my car's records were the only ones taken. This car lot has even refused to do an oil change on my car. These people had me waiting for four hours in their within room for this oil change until i finally told them to give it to me as it was. They then claimed that they put in oil but didn't change my filter. I was then informed that it would be less expensive for me to take the car elsewhere for the oil change. To the best of my knowledge we have a contract that states that all repairs I need done will be done and if pay fifty percent of the cost. That oil change fell in that category. In short they're not done any work on my car to include that which I have the lone copy of. I feel that they breached their contract with me from the start and intended to do so. I've not missed a payment on this overpriced purchase and I know that they are hoping that I do. What are my options in this matter.

It sounds like the dealership may have screwed you over. However, you failed to protect yourself and they are most likely going to get away with it. Dealerships work scams like this with the hope that you fail to ask for any paperwork to substantiate your claims, which is exactly what happened in your case.

What do you have to show what repairs were needed? Did you have the vehicle inspected by a third party?

Without something to show that the dealership failed to live up to their end of the bargain you are out of luck. You admit you took it in several times for repairs and the dealership will contend they fixed those items. They could even go back and create repair invoices if they really wanted to. Upon purchase (preferably before purchase) you should have had the car inspected by a third party. After every failed repair, you should have verified the failure through this third party. Then you would have a case. As it is, there is little hope of proving the breach.

Your best defense is to simply not to spend your money on anything that isn't purchase ready.

What's purchase ready?

It means if the item doesn't suit your fancy, don't buy it.

Why?

Because the seller will make promises just to get your money.

The item, however, will never function properly.
