My Landlady gave me a sixty day notice but with a ninety day move out date ...I moved after 60 days and she deducted the 30 days remaining from my security deposit for failing to give 30 days notice ..
I thought that the sixty day notice began when you are served the notice and that I was not required to give a 30 day notice in return. She states that the sixty day notice requires at least 60 days and therefore she was in her legal right to put in an ninety day move out date. Is she right?
Also my Landlady plans to use the unit for her pesonal use and entered the unit to make repairs as soon as I left,,,,,Can she still deduct monies from my security deposit for failng to give notice if she had no plans to re -rent the unit?

I don't understand. She was correct in being able to put a 90 day move out date. You are under no obligation to provide here with any notice since she has given you notice. If you were supposed to move out end of month and stayed 5 extra days, you might be liable for the entire final month (days 61-90) but no more than that. If the lease is silent with regard to the move out date and she gave you the ability to leave at any time, whether there can be a pro-rated amount for the last month might be debatable. I think the landlady doesn't know what she is talking about or there is a confusion with terminology.
