Consumer Fraud ebay scam

My husband ordered something off ebay and we received it but it was damaged. UPS came back the next day and picked it up and sent it back to the seller, but UPS is denying the claim because the seller did not properly package it. The seller is ignoring my phone calls. I paid with shipping charges $414.00. I filed a fraud police report. I am in nashville and he is in CA. Should i take him to small claims court. How can I get my money back?
 
How did you pay? PayPal or credit card?

Contact either and explain your situation that the merchandise was damaged, returned, and the vendor won't refund or talk to you. PayPal or your credit card company will contact the vendor and if not satisfied with their response will issue you a credit and a "chargeback" to the vendor.

You should also contact Ebay and provide negative feedback on this vendor.

What? There is no proof of fraud, and this would be a civil matter NOT criminal.
 
I paid through paypal, but since he made the car hoods when they are bought it took him longer to make and ship them out, so I was over my limit on ebay and paypal, so there is nothing they can do. They told me to file a police report. I have filed a complaint with the better business bureau and will hear something back within 30days.
 
The police won't help you get your money back. You would have to sue. To sue for $414 is not feasible. You would have to pay a filing fee, etc. and even if you won a judgement it does NOT guarantee you would be reimbursed. It would be up to you to enforce and collect on the judgement. Not an easy task.

I still say your best bet is to contact your credit card company. I assume your PayPal was connected to a credit card and not your checking account?

If this was ultimately paid by your credit card, simply dispute the charge. If it was out of your checking account and PayPal won't help, then you are probably screwed...

Don't expect any help from the Better Business Bureau either. They only collect and disseminate information. Unless the vendor is associated with the BBB and cares about their reputation, they probably would ignore any correspondence from the BBB.

Wasn't your purchase protected under the Ebay Buyer Protection? Check it out.

The best thing that you can do is to report that seller to the ebay.com tell them what happened and then give a bad feedback to that seller so other buyer won't become victims in future.
