What area do text messages fall into? And are they admissable

Well, you are writing as though you know for a fact that these thigns are true. And they are not. If you want to know more about tape recordings, you can google that. Try "authenticating tape recordings." I also remembered this: they are treated as written testimony, which is why I had asked...

Who legally owns this email address?

I won't have an attorney until late summer. It's just not in the cards financially right now. That's why I was asking here, to see if any of the regular people who post here know what the story is on this type of email set-up. I did look at your linked informaiton, but I don't see anything...

Who legally owns this email address?

Well, since the option is there on MY account to change the password and set rules for that account, then I feel almost certain that it is still owned by me, but I wanted to know if anyone knew, ie, had any experience with this, ie, knew anything more definitive.

What area do text messages fall into? And are they admissable

Oh, and i don't have an attorney, which is why I have to hunt for knowledge myself. I've had a few consultations, which is where I verified what it means to have a tape authenticated and found that I'd need to have it transcribed for maximum shock value.

What area do text messages fall into? And are they admissable

I;m sorry, but you are wrong on both of these matters. From what little I DO know, your info is not right. Tapes are admissable, as long as they are "autenticated," and this falls under federal law. This just means that the person who operated the recording device has to know how to do it (I...

    Due Process

I think that goes out the window if you do anything to continue it, even if you're asking for the court to give you an attorney. In other words, if YOU delay at ALL, you don't have that right. I dont' think they take this very seriously.

What area do text messages fall into? And are they admissable

I'm curious about this after reading about the restraining order on a different thread/section of this forum. Just how do you get saved text messages admitted as evidence? I've got lots and lots of them that I would like to use, but since I've not got an atty for now, I don't know how this is...

    Restraining Order Settlement Agreement

Also, I just reread that first post. Sounds like she's got two actions going against you, one is the restraining order and the other some suit for civil damages. So she claims not only that you put a video of her on the internet, smoking pot, but that she is so afraid of you that she has to...

    Restraining Order Settlement Agreement

Well, I don't think anyone who's not an attorney should ever, ever consider themselves smart in that area. One thing I've learned from all this domestic stuff is that just when you think you know what the law is on something, you find out that you're wrong. But about these restraining orders...

Who legally owns this email address?

Well, thank you for your input as far as morality goes, but this dude has pulled a lot of really, really dirty stuff out of his bag of tricks. Taking my kids, with no warning? Lying about me in court, under oath? Having his atty kick me around? Just becuase his attny CAN do that, doesn't mean...

Who legally owns this email address?

I see that I posted this in the wrong section of this forum (in family law, general). Didn't know there was a whole section here just for this kind of question. I had a paid account with America Online that began in 1998. From then until 2005, when AOL went the way of free email accounts, I...

Who legally "owns" this email address?

I had a paid account with America Online that began in 1998. From then until 2005, when AOL went the way of free email accounts, I paid the bill. I created an email account for my ex, and it was under the "master screen name," which is the one I created and paid for during those seven years...

    Children visitation

I have to agree with Prosperina here. I've got a similar situation, but my ex took my child to another state. Then he filed in our state because it's still got jurisdiction. It was explained to me by an attorney like this: Until the last person in the custody suit moves out of the state that...

    Restraining Order Settlement Agreement

I agree with the above. Just because that is what they are offering doesn't mean that you are going to have your life destroyed if you don't take it. If she was smoking pot and someone else put a video of it online, why is this even your problem? Sounds like you ought to let them try. Just...

Drug Crimes, Substance Abuse Probation Violation

But wouldn't he have to be **convicted** of a crime before they can claim he violated his probation? Or have I missed something else that was a violation? He wasn't allowed to consume alcohol as part of the probation? It just seems to me that you cannot be convicted of DUI if you are...
