malicious prosecution intentional tort or vexious litigation?

Being accused of a crime when there was no crime committed is Defamation. At this point, you need to prove your innocence via the video documentation (that I'm sure exists) that shows you entering the store and going to get your returns processed. You may need help in getting the video...

    Hypothetical: In negotiating a settlement

I believe that any settlement discussions before litigation are priviledged. The only options that may be available to you is to appeal the judgement, declare bankruptcy or pay it.

    Eviction Notice Demurrer

I think it is called 'Amending the Complaint'. A Plaintiff should have the right to amend a Complaint/Unlawful Detainer in response to a Demurrer, in an attempt to render the Demurrer moot.

    Car dealership took car back

With a down payment of 400.00 and only having the car for 4 days, you should expect to get something back out of the 400.00. The dealership might expect to get something because you was able to use their car for the 4 days, but not the entire deposit you put down.

Of course not! You are providing a roof over your children's head and food in their mouths! Sometimes we go through hard times and those of us who are resilient, can get through it. Good luck and my prayers for you on achieving a better life for you and your children.

    Injured as a pedestrian

Sure, you can contact the driver's insurance about paying your medical bills, but why not get an Attorney to do this for you? A Lawyer could probably get your medical bills paid and also a settlement for your 'pain and suffering'. An Attorney will make sure the Insurance Company doesn't take...

Personal injury claim against Pizza Hut

Unfortunately, Maryland is a state that takes serious consideration into one's negligence concerning such a claim. Carrying 2 large boxes of pizza, which made it impossible to look where you are going, isn't a very smart thing for you to do. I suspect you don't have much of a case!

I opened a case with dfcs because my child i belive was molested

So a Parent of a 4 year old child should be able to narrow down possibilities as to why the child would complain about being hurt in the butt! Did you leave the child with someone and then the child complained? What circumstances led up to the child's complaint? If there is evidence of...

Light injury accident (other party at fault)

So, you don't have Health Insurance, huh? Like the kind that allows you to go to the doctor and pay a minimal co-payment? If not, perhaps you can go to an Attorney, who will take your case on Contingency and provide a doctor who will put a lien on your settlement. Now-days, it is getting...

My husband is trying to take my car because he put the down payment down

If your husband, who has no license, takes your car again, call the police and explain that your husband took your car without your permission and that he is an unlicensed driver!

Negligence, Other Injury Marijuana Use Leads to Murder, Failure to Warn Lawsuit

Personally, I've had enough experience with marijuana in the '70's to know that in many instances, one under the influence can become fixated on one thing and totally neglect another, which in some cases, can put them in harms way! So, I definitely wouldn't classify it as a drug that wouldn't...

    Security deposit not refunded fully

So does the 190.00 represent the amount of security deposit that wasn't returned to you? If so, you should first write a letter to the LL describing your grievance concerning the failure to return you your security deposit. If the LL's response to your letter (sent via certified mail) isn't...

Not getting reinstated to old position after FMLA leave

The first thing you should have done was to contact your Union Representative to see if it is necessary to file a grievance. That is what the Union is for--to help you solve problems with your employment.

    a quick question

So, did you offer to help repair the vehicle to the extent that it would run again or did you offer to repair/replace the distributor? If the buyer bought the car based on you replacing the distributor and it still won't run afterwards, he may not have cause to return the car. If you, in any...
