Would I be breaking the law if I did this?

My mother-in-law owns a house 120 miles away in the area that I am from originally. I go there about 2-3 weekends/month. I have the cable phone and garbage there in my name. Is there any reason I can't just take the 4 kids there and register them for school and consider myself living there? No divorce papers or papers of any kind have been filed yet and it is really important to me that I am able to move up there where my family is and not be prevented from doing it. Should I just move before the legal ball gets rolling?
 
There really is no law against this but what makes you think your mother in law is going to cooperate with you when you are moving the kids away from Dad?

Since there is no court orders or divorce, either parent is technically free to do whateverr with the kids but I caution you, this can backfire on you in court especially if dad disputes this, and files for custody asking for the kids to be returned to where they are now.
 
Have you talked to the school district?
