My wife and I have separated. She left the house 6 months ago after telling me she had an affair with her business partner. She and I have been moving apart for years. Her relationship ended with that partner, but the business is now failed (a retail business) and she will be filing for bankruptcy. The business was an LLC and she and her partner are 50/50 partners, although he has no assets (partly why the business is failing). The main SBA loan that funded the business was signed by her, the partner and me (since she basically had no income or credit) and our home was provided as collateral (which we jointly own). Will her bankruptcy (personal) cause me to now be liable for that loan (since the partner has no assets/income)? Will I lose the home as a result? Should I be filing for formal separation/divorce prior to bankruptcy filing to ensure I am protected?
