In my area of New York State there is a public fishing access site bordered by private property. For years, we have waded from the public access site out in front of the private property. We have never trespassed on the property, but the new owner insists that he owns the bottom of the lake and we are therefore trespassing on his property. There is a high water mark boundary marker on the shore at the end of the fence separating his property from the public access site. I was under the impression that a person could not post property past the high water mark, meaning anything that is regularly under water. Is this the case or does this individual have the right to keep us out of the water in front of his property?
