I own a home in northern New York State that shares a well that is not on my property. The current owners of the land where the well is located have a mortgage with the previous owners, who are relatives, and have informed me that I have use of the well until their mortgage is paid in full in approximately 12 more years. I have owned the home for 12 years and the home has been on this well for 15 years. I have been told that I cannot do anything with the property such as build, sell etc. without a well in the property. Do I have any legal recourse to prevent the owners from removing me from the well and if so, what needs to be done? Thank you.
