Water Leak

We purchased our home a year and a half ago. We just discovered a water leak. After pulling up the carpet it is evident that it is a pre-existing condition by the presence of rust. At the time of purchase the home was newly constructed. Is the seller still liable? (If my memory serves me correct I think the seller is liable for up to two years.)
