Verbal Contracts and Real Estate

Ten years ago I purchased a two family home with my brother with the assumption that all payments would be split. Things have changed, my brother moved out of his flat and without discussing it with me he rented out the flat. I feel that since he left the house our verbal agreement is now null and void and he has no right to rent the apartment out.

His name is not on the deed, nor is it on the mortgage that I pay. He did not attend the closing either. The way I see it I have been liable for the house all along and since he moved out he has no rights. He feels that we had a verbal agreement and I should buy his half out.
 
Tell him the money he paid was for rent only and that he owns nothing since verbal contracts for real estate are void.

Then hope for the best....
