Spousal support arrears (no child support ) reduced to judgement and ex-wife remarries 4 days later -- aren't spousal support arrears simply spousal support period and by code doesn't the remarriage negate the spousal support arrears? The arrears have to be included in gross income of ex and deducted from gross income of payer.Thanks
 
Nope. Arrears are not wiped upon wife remarrying.


CURRENT support would probably stop, assuming the court order was actually modifiable.

Ex needs to pay up.

So, if the ex cannot pay up, since it is a judgement, is it only enforceable by collection efforts now, and not by contempt power?....
 
Right.

Since it's now a civil matter, the court won't find him in contempt.

Unfortunately for the wife, the ex can actually now discharge this in a bankruptcy filing if he chooses to do so.
