Hi, I received a Summons for UPM. I'm assuming it stands for Unauthorized Possesion of Marijuana. This happened in NY. On the Summons, it says that I am "In Violation Of Sec 221 Sub 05" and the "Description of Criminal Court Offense is UPM".
They caught me with a small bag of marijuana on me, and took me to the precent and gave me a summons and let me go. What I need to know is what the "Sec" and "Sub" means in the violation, and what conseqences/fines there are. From the www.norml.org site, it says for first time offenses (which it is) it is a civil citation, no jail time and a $100 fine. Is that the current and correct fines? Is there penalties to my dirivers license? On my record, will it always say UPM or does it go away after some time?
Should I get an attorney, or get one of those free attoneys when I go into court?
