Unpaid vacation lost?

I had 40 hours of vacation time accrued at my last job when I gave them my 2 week notice. 2 days after giving my notice my supervisor called and told me "we are just going to be done with you now". After I received my final check (over a week and half after they "were done with me" plus an actual payday had come and gone) my vacation pay was not included. When I called HR, I was informed that they do not pay accrued vacation hours in the event an employee is no longer employed by them. IS this legal?

Whether or not unused vacation has to be paid out at termination is a feature of state law. What state are you in?
