Trustee election

I live in a condominium in Massachusetts. There has been a vacancy on the Board of Trustees. The docs state that a replacement Trustee can be elected by 51% of the community within 30 days. If noone is elected within 30 days, the remaining Trustees may appoint a Trustee. The docs do not state that an election meeting is required.

A resident of the community has drafted an Absentee Ballot form and has obtained signatures of more than 51% of the community to elect himself as Trustee. The Absentee Ballot is a simple form as follows:

ABSENTEE BALLOT
As of July 10, 2007 there is one (1) vacancy on the Board of Trustees for the ABC Trust.
I ________________________ vote the following individual as Trustee to fill said vacancy.
